"Scare Tactic" Doesn't Stop Sun City Anthem Resident's Request to Obtain Financial Information (Part One of Two)

Remember the infamous "Bella...gate" a couple of months ago when $2600 of association funds was spent on buses for strangers to get to a Hillary Clinton rally?

We received a phone call from one of our readers, Robert Nusser, who, after being made aware of uncontrolled association waste, decided that ...

"Enough Was Enough"

...and...

...he had the courage to do something about it.

Mr. Nusser is a retired Federal Investigator and owned his own company.  His belief is simply...

 "If you watch the pennies, the dollars watch themselves". 

According to Mr. Nusser, "After my wife and I worked very hard for 40+ years, we only wanted to retire in a WELL-RUN community to enjoy our remaining years".

He soon questioned that decision after learning of the "Hillary buses", the restaurant closures, and the Liberty Center closing.

Mr. Nusser submitted a "Sun City Anthem Document Request Form" to obtain just how much of our association funds were spent on various items... a form many of you probably do not know exists that allows you as a unit owner to obtain information YOU ARE ENTITLED TO RECEIVE.

He made the following official request:

"Copies of reimbursements issued to the Board of Directors for paid expenses in calendar year 2015"

A few weeks later he was presented with a pile of documents, along with an unusual demand in order to have the information released to him...

...an unusual and informal "Affidavit" stating:

"As a member of Sun City Anthem Community Association, Inc. (Association), I hereby agree that I will not disseminate documents I requested and received from the Association to any other party".

"These documents are being received and reviewed by me only.  I understand that the documents being provided to me are of a sensitive nature and will preserve the integrity of the documents accordingly".

The strange aspect of the affidavit requested he PRINT his name, not sign it, and it was witnessed by an individual named "Lori Martin". 

No title was given and the affidavit was not placed on any particular company stationery.

Lori Martin is the FRS Community Association Manager and from what it has been learned, is being retained by Sandy Seddon as of the April 1, 2016 self-management transition.

This document was so unusual that we discussed this with the Nevada Real Estate Division as to the authority of any individual denying any unit member,  information to which that person is entitled, much less requiring that person to do so by affidavit,  requiring it "not be  disseminated to any other party".

The result....it was against Nevada statutes to do so with the following potential penalty:

Here is what we received:

"Neither the community manager nor the board can try by intimidation, threats, bullying or any other means to force a member to sign any affidavit or other document that limits what they can do with documents received.


If the community manager or the board tries to enforce any attempted restrictions, a formal complaint to the Nevada Real Estate Division can be filed against the community manager. 

The Division has the administrative authority to fine the community manager up to $1000 per violation

A complaint can also be filed against the board or any board member(s) that can result in fines to the board member(s) personally of up to $1,000 per violation and/or removal from the board

Even if the offending board member(s) are no longer on the board the fines can still be imposed."

Once this determination was received, Mr. Nusser contacted Anthem Opinions and a meeting took place where detailed notes were taken as to the contents of the documents he received.

It was from those detailed notes, that beginning tomorrow, we will expose the massive expenses authorized by Bella Meese,  the President of the Sun City Anthem Board, and signed receipts of a personal credit card issued to...

Thomas Nissen, the Sun City Anthem Treasurer...

...who submitted those receipts and received FULL REIMBURSEMENT by Sun City Anthem funds.

...the same Thomas Nissen who is running for election to the Sun CIty Anthem Board.
