RMI History Dictates a Change in Management Company

You Can Run...but...You Can't Hide

Just how much will a community stand for if a board of directors retains a management company that has caused as much havoc as the one we currently use here in Sun City Anthem?


Time and again, RMI (Resource Management, Inc.) who recently changed its name to First Service Residential (FSR), has been retained again and again, by boards who have knowingly closed their eyes to bidding irregularities, causing our community to waste HUGE sums of association funds on overpriced items.

Though there are too many to discuss here, perhaps the most flagrant example of waste took place in 2008 when the Las Vegas valley experienced an 8 inch snowfall that collapsed a shading structure located at Independence Center.

It was subsequently learned that the RMI employee who was responsible for obtaining the bids, KNOWINGLY retained a firm that HAD NO BUSINESS LICENSE, and NO INSURANCE.

Needless to say, had the collapse of the shading harmed or perhaps killed an innocent individual, we, Sun City Anthem, would have incurred a SUBSTANTIAL LIABILITY as a result of that NEGLIGENCE.

Any individual who has ever been in business for themselves, having experienced such incompetence, would have IMMEDIATELY terminated the services of ANY individual who subjected a firm to UNNECESSARY liability. That is how THE REAL WORLD reacts to such matters.

The board at that time, not only IGNORED the matter, but ALSO authorized RMI to pay the SAME unlicensed individual $5,000....YOUR MONEY...to repair the damage.

It was easier to write a check..YOUR CHECK... than STAND UP for what was right, and tell RMI...

PAY UP, or GET LOST....at time of contract renewal.

...and that...is POOR leadership, INCOMPETENT leadership, ARROGANT leadership. or perhaps...CORRUPT leadership. 

Shortly thereafter, it came time to consider renewing the management contact and yet another TRAVESTY took place...resulting from the action of a then Board President, who REFUSED to place the contract to competitive bid....IGNORING NEVADA STATUTES...under the guise of a loophole referred to as "practicability". 

RMI was renewed for a three year period.  At the same time, the employee who created the potential SUBSTANTIAL shading structure liability to our community,  was RETAINED.

That contract expired on December 31, 2012; however, it has been extended month after month for no reason other than PROCRASTINATION or perhaps some other BACKDOOR arrangement.

As the contract termination date approached the board at that time...

...essentially the SAME individuals who are presently seated on our board...

...were being strongly pressured into examining management company alternatives; and at first, it appeared they would make an "honest attempt" to obtain information from other firms.

And so...a special committee was appointed to examine alternatives.

That committee did an EXCELLENT job in examining various firms, and the result they reported to that/this board, was that there were a number of suitable firms available...so many, that RMI was placed FIFTH on a list as to their suggestions.

What did that/this board do?

It IGNORED the hard work of that group, and instead, chose three individuals to further explore the matter.

It was questionable as to the result these three individuals would recommend...for one reason...they were HAND PICKED by that/this board...the same group who AGAIN and AGAIN, would "go through the motions" to appease residents, yet, in the opinions of MANY, would do nothing other than TELL THEM WHAT THEY WANTED TO HEAR.

BUT...they were shocked by the recommendations of two of these three individuals...as were a number of those present in the audience.

They recommended that RMI be REPLACED.

I strongly suggest that you read an article located in the "Where I Stand" forum of Anthem Today, authored by a resident identified as "Lynn W" and make sure you also read the PROFOUND comments of other residents as well. No better or more accurate summary of that meeting could have ever been written.

This board did NOT hear what they WANTED TO HEAR....they instead, heard a professional presentation that had the audience leaving with a positive attitude that FINALLY, something was going to take place; that this board WAS LISTENING to people, and that it would be a matter of time before a transition would occur.

After all, TWO COMMITTEES had now recommended a change, and only a short time ago, this board came forward and denied a Pet Park project, PRAISING the input and effectiveness of committees, and feeling compelled to accept their recommendation.

TWO of the THREE individuals charged with the task of examining alternatives.....recommended that  RMI BE REPLACED with another firm, Capital Consultants Management Corp, referred to as CCMC.

And their point system didn't even consider the past problems associated with RMI.

Did this board...the same group who just a few short weeks ago, praised the value of committees...continue that belief and accept the recommendation?

NO...they DID NOT

They instead determined that they "needed more time" to decide the matter.
....obviously "conveniently" forgetting previous, as well as, the current RMI problems.

And the gall of an alternative blogger to write:

"the Board has taken the right approach in deciding to negotiate with both companies in order to obtain answers to hard questions that the Task Force may not have been in a position to address"

...is literally an insulting  SLAP ON THE FACE to the efforts of both those committees.

While this fiasco continues, yet another issue has reared its ugly head...AGAIN.

A few months ago, resident Mary Schramski, feeling compassion for a number of resident monitors for the manner in which they were being treated and allegedly HARASSED by Fitness Director, Kathy Kline, whose actions were condoned by Community Association Manager, Rob Feldman, started a very successful petition that demanded these individuals, who had years of tireless service, be treated in both a CORDIAL and PROFESSIONAL manner.

This in turn created such a stir that a meeting was held in which the Fitness Director was literally "called on the carpet" as a result of the accusations, as well as, for the types of equipment purchased, and the individuals she hand picked as personal trainers.

The room was filled, and an overwhelming number of residents were present...only to hear Board Member, Mike Carey, DEFEND the RMI actions.
Since that time, even more scrutiny of RMI has occurred.

Rob Feldman is now the 5th Community Association Manager that has been chosen by RMI in the past 8 years...and when asked to provide his resume to determine his qualifications...REFUSED to provide it.

Now...a few months later...more monitors have subsequently left feeling they were harassed, and the matter has been pursued to RMI Human Resources for evaluation.

..but rather than express ANY concern for HIS NEIGHBORS, those increasing numbers of monitors who have expressed problems with employee morale and treatment on the job....

...the alternative blogger, in yet another attempt to  justify board procrastination....INSULTS THESE DEDICATED individuals instead.

"While I don't think a lot of attention should be paid to anonymous critics, I also think we have to expect that residents who work as part-time employees of the management company are EMPLOYEES, not residents, for the time they are on duty."

Yes, they are employees, but MORE IMPORTANTLY, they are our neighbors who have served the needs of this community tirelessly for YEARS.
So....what is going on?


Is this board...ABOVE BOARD...in the manner in which they SAY ONE THING, yet PRACTICE ANOTHER?

Just WHY is the management company choice still being considered after such a thorough investigation?

This would appear to be a NO-BRAINER....and perhaps that just might be the reason for the procrastination.

Has this had other affects of our community?

Over the past number of weeks, it has become evident that more and more volunteers are being solicited for community involvement.  The reason....less people are interested in volunteering to serve a system they believe does not respect their individual thoughts and recommendations.

They feel that THEY ARE BEING CONTROLLED...and based on these details, there leaves little doubt that THEY ARE CORRECT in their beliefs.

And to further enhance this, yet another CONTROLLING proposal has been suggested by another board member and past president, James Long...

...a committee to enlist residents to drive the streets of our community looking for Association violations...a proposal now being referred to as "the rat squad."

This is what WE have allowed to HAPPEN by electing those who have created these problems

This is what WE have allowed to HAPPEN by reading and being foolish enough to believe such slanted material that does little other than SANCTION these acts.

...AND...unless you take these matters seriously, it WILL GET WORSE.
It is time for even the least active individual who resides in our community, to look carefully at these matters, and during the next board election, make sure any candidate who runs, knows full well....

THEY WORK FOR YOU...

...that if your committees have SPOKEN, and if you have any desire to continue having people volunteer to make your job easier....

Then...respect their decisions...

...OR...

Do all the work yourselves !

Another Scam to Watch


HOW I ALMOST GOT DUPED!

I do take pride that I am a tech savy, with it, kind of guy.  Not too much slips by me, but a new one came to me and everyone needs to hear about it.

I received a text from Chase Bank that asked if I was trying to make a large purchase of $5,700 on my Chase credit card.  It said text back1” if this is accurate or “2if it is not me


This was not unusual since Citibank had once done that with a charge that I had made, and it was a security check to make sure I was making a purchase.

Since this time it was not my charge, I texted back “2” to confirm that it was a false charge.  Within a minute, another text came saying thank you and the Chase Fraud Department would follow up with me and look into the false attempt.

A 2nd text came in saying that I should call the Chase Fraud Unit and gave me the 800 number and a transaction code to put in the phone when the automatic system answered.  I did as instructed. 

Then...I blew it

The auto attendant said put in my card number to begin.  Since I was dealing directly with Chase Fraud, I did as instructed. 

Within 10 seconds, my brain started to work and I smelled a rat.  I hung up the phone and I dialed Chase Bank on a number that I looked up on the Chase website.  The REAL fraud unit said my account was fine and they did not call nor text me. 

I had been had ! 

Needless to say, my card was immediately canceled without any false charges, and they are sending a replacement card.

Then the fun began

I called the number on the text and a real person picked up and said “Chase Fraud Unit, can I help you?”

I told them that I received the text and did not know what to do. The nice lady said she would help me.  I then asked her name and phone number so if we got disconnected, I could call her back.  She actually gave me a name and number.

I then asked her to check her information to make sure it was my card and she said the computers are down so she could not comply with my request

 Here is the number I called   800-978-8664

The auto attendant says Chase Fraud Unit. This is a scam

They wanted me to give them confidential information so they could steal from me.

Had I not called the REAL Chase and canceled my card, I am confident that they would have emptied my account

The first moral of the story.

IF YOU GET MAIL, TEXT, EMAIL OR ANY COMMUNICATION ASKING FOR ANY PERSONAL INFORMATION, ACCOUNT NUMBERS, TRANSACTIONS, DO NOT RESPOND...

...YOU SHOULD INITIATE ANY CONVERSATION BY LOOKING UP THE NUMBER AND CALLING THEM. 

 DO NOT CALL THE PHONE NUMBER THAT THE SCAMMERS GIVE YOU. 

DO NOT PAY ATTENTION TO ANY LOGO ON COMMUNICATIONS AS SCAMMERS DUPLICATE THEM.

SPECIAL BULLETIN

Mt. Charleston Fires Continue to Burn...
Only 10% Contained


Our heartfelt prayers go to the residents of Mt. Charleston and the bravery of the dedicated firefighters who have fought courageously this past week in their continuing efforts at containing the fires that now have crossed Kyle Canyon and have claimed at least one home.

We can only hope that we do not experience anything like the tragedy of the Prescott, Arizona fires.

Miniature Golf has its Flaws according to Anonymous Blogger

Once again, due to its length and depth, we have reprinted it in its entirety in order that you may draw your own conclusions.
AS AN ANONYMOUS RESPONDER, I HAD DECIDED JUST TO OFFER AN OPINION, BUT NOT GET INTO A GIVE AND TAKE AND DISAGREEMENT WITH THE BLOGGER WHO IS TRYING TO PUSH HIS OWN AGENDA AND PROVIDE BIASED INFORMATION ON THE SUBJECT OF A MINI GOLF ALTERNATIVE.  
I AM FORCED TO RESPOND ONCE AGAIN TO BALANCE OUT THE FIELD. 
I REMAIN ANONYMOUS AND JUST WANT TO SUPPLY MY OPINION WITHOUT THE INFLUENCE OF THE QUESTIONABLE BLOGGER.

Why are you proposing a mini-golf layout for the Liberty Center bocce courts?
It started with a blog survey whose results indicated a preference for miniature golf over other possibilities for the site. As our volunteers contact residents throughout the community and obtain signatures on petitions favoring the proposal, it is clear that the interest is there.

ONCE AGAIN THIS AUTHOR MAKES IT APPEAR LIKE THIS IS AN OVERWHELMING CRY OUT FOR THIS ALTERNATIVE.  I MUST AGAIN REMIND ALL THAT WHEN YOU DO A SURVEY OF A SPECIFIC GROUP, YOU CAN PREDICT RESULTS.  THAT IS MERELY A WAY TO MAKE OTHER THAT HAVE NOT BEEN INVOLVED FEEL AS THOUGH THAT IS THE MAJORITY OPINION WHEN IN FACT IT IS A SMALL SLICE OF THE COMMUNITY.
MR. BLOGGER, IF THERE IS SUCH AN OVERWHELMING RESULT, WHY NOT PUBLISH THE NUMBERS?  SINCE THIS SO-CALLED PETITION HAS STARTED WITH ALL THESE VOLUNTEERS, I HAVE YET TO HEAR OR MEET ONE PERSON OF THE 12,000 RESIDENTS THAT HAVE BEEN APPROACHED WITH THIS PETITION. PERHAPS, THE MANY REFERRED TO BY THIS BLOGGER WITH AN AGENDA IS MOSTLY IN HIS HEAD!

Why would mini-golf be a better amenity than others that might be worth considering? 

The criteria for suggesting this amenity above others are straightforward: It is one of the few outdoor activities that can be played by almost anyone, regardless of age or physical limitations, and it would comply with the requirements of the Americans With Disabilities Act. Playing equipment is provided, meaning that players don’t have to provide their own equipment or wear special clothing. It would provide an activity that does not duplicate any activity currently available to our members. And it involves a concept that would develop both sections of Liberty Center bocce courts and place the amenity in a setting that, as proposed, would have a park-like look and feel.

A pet park and shuffleboard are other suggestions that have been made for this site. Are you opposing these ideas?
This reporter and our team are not specifically opposing any proposal, even if it competes with the mini-golf concept. Any groups that have proposals they want to advocate can gather what support they can and go through the Properties & Grounds Committee vetting process if they wish. That being said, I don’t think installing shuffleboard would be the best option for the Liberty Center site. At this time, I have not seen a groundswell of advocacy for shuffleboard, (NOR A GROUND SWELL FOR MINI GOLFand it is really difficult to advocate for an amenity if community support cannot be demonstrated. In addition, because shuffleboard is a linear sport that basically involves just pushing a disc back and forth, (AND MINI GOLF IS JUST ROLLING A BALL AROUND!) there may be one or more better locations for it if the interest is there. We intend to demonstrate interest in mini-golf, but where other options are concerned there may be an object lesson in the fact that our horseshoe pits get almost no use; some residents probably don’t even know that we have horseshoe pits, and where they are located.

Another community blogger claimed that data from the miniature golf course at Sun City Summerlin indicate light usage, resulting in his conclusion that mini-golf in Sun City Anthem would not attract sufficient traffic to justify the cost.

The Sun City Summerlin usage figures obtained by that blogger –the same data I received- are not representative of the actual usage their mini-golf facility experiences. Sun City Summerlin is home to two championship golf courses and an executive-length course, and I was told that large numbers of the residents who use these courses also visit and play on the miniature golf course, bringing their own putters and balls to do so. Because these players don’t need to check in with a fitness monitor, there is no data that show the actual total usage. 
AS A GOLFER, I DOUBT, BASED ON EXPERIENCE, THAT THIS COMMENT ON GOLFERS HAS ANY VALIDITY.  IT IS ONLY A PRESUMPTION MADE BY THE BLOGGER TO ADVOCATE HIS DESIRE TO INFLUENCE THE READERS.

In addition, we plan to take an approach tailored to the needs and interests of our own community. Among the possibilities: chartered mini-golf club; tournaments and charity fund-raising events; encouragement for some of our many chartered clubs to include mini-golf as a part of their own special events; etc.
I heard that children are prohibited from participating in any activities at Liberty Center. Is this true, and if so, how could we play mini-golf there with our visiting grandchildren?
There is a rumor going around to that effect, but it is false. The ONLY restriction on children is that they are prohibited from using the swimming pools and Jacuzzi at Liberty Center, and instead may use only the pools at Anthem Center during designated hours. For all other amenities, established free-play and club guest policies apply. If SCA wanted to have a policy for young mini-golf visitors, it could establish a reasonable procedure, for example requiring that visitors must be at least a certain age to play the course.
SO WE NOW SAY IT IS FOR GRANDCHILDREN, BUT ONLY FOR CERTAIN AGES.  THAT IS RIDICULOUS.
 WE SAY THIS COULD BE FOR GRANDCHILDREN BUT NOT ALL GRANDCHILDREN. 
AND THEN, IF THEY DO QUALIFY BASED ON AGE, THEY DO NOT QUALIFY TO GO SWIMMING AT THE POOL THAT IS LOCATED IN THE SAME CENTER.
EITHER HAVE OPEN HOURS FOR ALL ,OR DO NOT HAVE THE YOUNGSTERS THERE AT ALL.

I HAVE BEEN TOLD (NOT OFFICIALLY OR IN WRITING) THAT THE LIBERTY CENTER IS AN ADULT FACILITY AND NOT FOR KIDS.

 Constructing a mini-golf layout is certainly going to be expensive. How do you respond to the argument that this is an expense SCA cannot afford?

It would be one of the larger single-item expenses we would incur since transition to resident control in 2005. But I would suggest that this reality should be balanced off by the opportunity to redevelop a site that exceeds 11,000 square feet, large enough to host several single-story homes. Our community is noted for, among other things, its first-class, well-maintained collection of amenities, supported by a well-controlled dues structure that exceeds what any other age-restricted community offers its members relative to the fees they pay. And of course, the cost of construction will not affect our dues because it will come from the Asset Enhancement Fee of one third of one percent collected on the sale of SCA homes.
THE ARGUMENT THAT IT WILL NOT IMPACT OUR DUES IS JUST PLAIN STUPID. 

 MONEY SPENT AT SCA IS REAL MONEY.


ANY MONEY SPENT IN THE COMMUNITY IS A COST OF THE COMMUNITY. TO SAY THAT THIS WILL NOT AFFECT OUR DUES IS MISLEADING.  ANY MONEY SPENT AFFECTS ALL OF US

 Some are complaining that the Asset Enhancement Fee is discriminatory, and they would like the SCA Board of Directors to eliminate it. Wouldn’t that take away the source of funds for new capital projects such as mini-golf?

Yes it would, but the Asset Enhancement Fee is not going away for the foreseeable future. (THIS STATEMENT IS RATHER PRESUMPTUOUS )
Critics who would like it to disappear via action by the Board of Directors simply do not understand that the Asset Enhancement Fee is incorporated in the CC&Rs of our Association, which require an affirmative vote of 67% of our 7,144 homeowners, or 4,787 homes, to change. Anyone who wants to eliminate the Asset Enhancement Fee must overcome that hurdle, and I see no movement among critics of the fee to work toward that change.
THIS MAY BE A GOOD ALTERNATIVE.

 IF THE AUTHOR OF THE BLOG WOULD RALLY THE RESIDENTS WITH THE SAME DEGREE OF ENTHUSIASM FOR THE MINI-GOLF, WE MAY GET THE NECESSARY VOTES TO ELIMINATE THIS DISCRIMINATORY FEE. 


WHY IS IT FAIR TO HAVE FEES PAID ON THE TRANSFER OF PROPERTY?

In that case, even if the Asset Enhancement Fee funds the project without impacting our annual Association fees, how much would the mini-golf project cost anyway.
As noted earlier, this would be a major project involving a substantial piece of land, and like most everything in life, we get what we pay for. Companies specializing in design and construction of miniature golf courses say the cost would be at the lower end of the range because (1) we are suggesting a 9-hole “putting course,” not an 18-hole course, and (2) we are not advocating expensive water features such as streams and waterfalls, as well as constructed objects such as castles and windmills. While it would be up to the P&G Committee in conjunction with Facilities and the Project Manager to establish a budget that companies could bid against, $100,000 might be a reasonable figure. If this turned out to be the figure, it would amount to the equivalent of a one-time expense of less than $15 per SCA household, though of course our households would not incur that expense due to the availability of the Asset Enhancement Fee.
 But surely there would be upkeep and maintenance cost that we would have to budget for. Would these expenses not have a direct affect on our budget, meaning our dues could go up as a result?
We can’t have any recreational amenities without budgeting for such items as repair, refurbishment, maintenance and replacement. ALL our amenities have some sort of ongoing cost associated with them, and our Finance Committee and Board calculate and include these costs in our annual budgets. To not do so is to allow our community to fall into disrepair.

The major upkeep expense for a miniature golf course is the replacement of the artificial putting surface, estimated to be every three to seven years, depending on usage. Otherwise, this amenity is almost maintenance-free, though there would be a continuous landscaping expense and minor cleaning/repairs. All in all, our research indicates that mini-golf facilities are among the lowest-cost-to-maintain amenities of any type of recreational facilities.
For just one example of the costs we incur to maintain the condition of our recreational facilities, do you know how much it is going to cost to resurface eight SCA tennis courts? The answer is at the end of this article.
 At least one critic has stated, in so many words, that a mini-golf amenity would stand unused during long periods because of our challenging hot weather during several months of the year. Doesn’t this weaken your argument in favor of this proposal?
Hardly. Noel Coward wrote that “only mad dogs and Englishmen go out in the midday sun.”  This certainly applies to Sun City Anthem, where you can drive around in the middle of a hot day and see almost ALL of our outdoor recreational facilities (except for the pools) standing idle. Mini-golf would be no different, and it certainly would be no worse.

SO IF IT WON'T BE USED, WHY BUILD IT ?
Summary: A retirement community such as ours works best when it caters to as many needs and interests as possible. There is NO single amenity used by more than a small percentage of our residents. What we offer is choices, because one of the things that makes SCA attractive to prospective and new residents is the cornucopia of activities from which we can choose. For any one activity that attracts participation, there will be substantially more who do not participate in that activity. We give our residents these choices because this is what makes SCA so special.

To reiterate the basis for the mini-golf proposal:
    An amenity that does not duplicate any other amenities currently available.
 
 
    An amenity that can be enjoyed by almost everyone, including those with limitations or lack of skills that prevent participation in some other activities.
 
 
    An amenity that visitors of almost all ages can enjoy. 


    An amenity that offers opportunities for special events, tournaments, fundraisers, etc., because everyone can participate.

MINI-GOLF MAY BE A VIABLE OPTION FOR THE LIBERTY CENTER. THERE ARE MANY THINGS TO CONSIDER IN THIS PROCESS.



MY OBJECTION TO THE PROCESS THAT APPEARS TO BE TAKING PLACE ON THE ONE BLOG IS THAT IT IS PUSHING AND ATTEMPTING TO CONTROL THE ISSUE.
