Sun City Anthem Management Declares War on Residents Attempting to Obtain Information
This time the Sun City Anthem General Manager, at the likely direction of a Sun City Anthem Attorney, with full cooperation from the existing Sun City Anthem Board, have literally declared war on unit owners attempting to obtain information to which they are legally entitled.
Sun City Anthem recently introduced a new policy for obtaining documents under NRS 116.31175.
"If a unit owner requests any association documents directly from the office or attempts to do so by an on-line note, there is now a mandatory non-disclosure agreement required before the documents will be provided. This covers any and all association documents available to a unit owner who is not a board member or an officer."
Accordingly, a long-time Sun City Anthem resident took the matter so seriously, that individual subsequently wrote this email to the Nevada Real Estate Division's Office of the Ombudsman:
"Please advise if there is anything in NRS 116 or NAC 116 that provides for the association to do this. If so I hope you can give me some guidance on the law/code to help me understand.
If there is ability of the board to require this non-disclosure agreement and the unit owner refuses to sign the non-disclosure agreement, how does this affect the fines to the board after 21 days shown in section 3 of NRS 116.31175?"
To which he received this response from the Office of the Ombudsman:
"Thank you for forwarding the document.
We both know that NRS 116 requires that records be provided or made available to unit owners upon written request.
After speaking with the Ombudsman, the availability of records as described in NRS 116.31175 cannot be conditioned on a non-disclosure contract.
Refusal to sign such an agreement does not alleviate the association’s obligation to provide or make available records of the association.
The “mandatory acknowledgement” form that you provided is contrary to NRS 116, as such a document is not required by law."
On Tuesday, March 20th, we learned that a resident made a document request, submitting the form WITHOUT SIGNING IT...
...and was initially informed the request would NOT BE GRANTED UNLESS THE NEW DOCUMENT REQUEST FORM...
...which included a nondisclosure requirement with corresponding threatening penalties...
...WAS SIGNED.
The Sun City Anthem employee in the Anthem Center Office, without giving the individual the written formal acknowledgement of receipt, accepted the document request form.
While waiting for the Sun City Anthem employee, the individual making the request heard another individual in the office state that others had also made requests and refused to sign the disclosure form.
He refused to sign the disclosure statement based on his belief this violated Nevada law.
We have no idea if the request will be granted, and we will tell you, our readers, if the requests are subsequently provided.
The association has up to 21 days to respond, and based on past requests, normally the full 21 days passes before any document request is granted.
Despite the Office of the Ombudsman declaring a signed nondisclosure statement violated NRS regulations...
...in checking the Sun City Anthem website, the same form is still present DEMANDING the disclosure form be signed.

3. Once that new screen opens, scroll down to a blue rectangle entitled "Doc Request Form" and then click on the blue area.

These requirements NEVER BEFORE EXISTED...and in our opinion, are an attempt to STONEWALL information that according to law, should be readily available to any unit owner....
...creating UNDUE FEAR AND HARASSMENT in the mind of any person who might wish to make a request.
Has this Board, General Manager, and new Association Attorney now gone too far?
Is this an example of the transparency Board members and the General Manager have pledged to the community?
Are there any of you that continue to DOUBT our allegations and concerns about the governance and management of Sun City Anthem...
...or will you or others who continue to support or ignore these oppressive tactics....
...that in excess of 1,200 good and caring people of Sun City Anthem...
...made every attempt to rid themselves of during the removal effort a few months ago ???
Let this be a lesson as to who you believe in this community, and who deceives you in order to maintain this oppressive behavior.
We MUST rid ourselves of such individuals.
If not, what next?
For now, if you choose to obtain information from Sun City Anthem, based on this correspondence received from the Office of Ombudsman...
REFUSE TO SIGN IT
and
FILE A COMPLAINT WITH THE NEVADA REAL ESTATE DIVISION.
Most importantly, if you condemn this activity or believe such behavior must cease...
You must NOT endorse or accept such action from our community leadership.
Those individuals include the current members of the Sun City Anthem Board....who, with their support of such actions, are responsible for allowing a General Manager to reduce your ability to "police" their actions....
...especially those running for reelection !
We must NOT reelect...

...such individuals take IMMEDIATE ACTION TO TERMINATE THE RELATIONSHIP with General Manager, Sandra Seddon, and Association Attorney, Adam Clarkson.
Little doubt can now remain that the combined actions of these individuals have created the worst chaos that has ever been allowed to exist in Sun City Anthem's 19 year existence.
This is our community, and we must take it back...
...or they will continue to...

Kudo’s to Mr. Goldstein in a previous article for his financial comparison outline of the Sun City Summerlin self-managed senior community which is larger than Sun City Anthem.
It shows that self-management can be effective and successful, when fiscal responsibility and oversight is utilized by competent board members!!
This information clearly exposes the exorbitant salary that our General Manager is receiving, with less job responsibility.
It’s those important “Princess” credentials and certifications that we are paying for……..right?

Any reason you FAILED to inform your readers about the ILLEGAL DISCLOSURE FORM the ones YOU ENDORSE, fully SANCTIONED ???
Of course not, that would have to involve TELLING THE FULL TRUTH about the latest attempt they obviously supported to PROVE their attempts to BLOCK ANY OWNER from obtaining any relevant community financial information to which they are LEGALLY ENTITLED....

Your background track record is disgusting, and any individual who would look at you as some kind of respectable role model whose advice is worth anything for endorsing such trickery, deception and total failure, is obviously every bit the loser in life yours has proven to be.

With all the money that has been lost on SCA restaurants that you have FULLY ENDORSED over the years and your ENDORSEMENTS of those who have been responsible for those substantial losses, what you really are, is the poster boy for FAILURE, not just in SCA, but in life.
Do we need to tell the community of the history of attempts to contact board members to explain the past business records of those who operated the restaurants? You never did, but WE DID.
Here's a quick summary of the "wise" decisions YOU ENDORSED and those dumb board members who led us down a 5 time LOSING path, made.
1. Giving a lease to a guy and his wife...the guy serving 6 years in a Colorado Penitentiary for robbing 8 Las Vegas banks.
2. Giving $40,000 of loans to a guy who was delinquent in rent and utilities...without proper financial vetting.
3. Giving a lease to a guy who had an outstanding $150,000 judgment against him that had not been satisfied with a defendant having first call on any money.
4. A TV cook who now runs a sandwich shop near UNLV.
So Mr. Nobody, I suggest you take some more depression pills. You obviously need them to tell yourself you are a somebody; when in fact, most of us look at you as the mentally impaired laughing stock of Sun City Anthem who is despised by most people...other than your nameless groupies.
How about we put you under a lie detector test so the community can finally see the FRAUD you have always been?
Now go to your meetings, sit there with your recorder, and make like a big man whose life centers around trolling a community between visits to the many angry discussions people have witnessed you have had with Green Valley video poker machines...after the M Resort told you to "take a hike" a number of years ago.
Go spend mommy's money. We know you never earned much of your own.
And oh yes...Aletta Waterhouse was a LIBRARIAN without a lick of business experience....just a bureaucrat like you who "tells people how to do it"...but NEVER have done it themselves.
They know that if they need corruption, lies, and insults, you'll always their "go to guy".
