Apathy...The 2017 Sun City Anthem Removal Election....Part Two of Three

Why Removal Proponents Chose Not to Participate in The 2018 Sun City Anthem Board Elections

(Part Two of Three)

Yesterday, we ended Part One of  the "historical" removal election documentary with the statement that Legal Trickery caused the Nevada Real Estate Division to deny the first complaint.

Today, we'll go into that trickery and subsequent actions of THE SCAM.

At the time the Treasurer's publication was sent and subsequently distributed by the Sun City Anthem employee to the Club Presidents...

..THE PETITIONS HAD NOT YET BEEN SUBMITTED FOR VERIFICATION ...

...that THERE WAS NO FORMAL REMOVAL IN EFFECT when the publication was made.

In other words, the action likely would have required "equal time" had the Association Treasurer made the statements after the petition signatures would have been submitted.

...and make no mistake...a Sun City Anthem association attorney WAS PAID by YOU to make sure THE OTHER SIDE WAS NEVER TOLD.

...a tricky political maneuver to keep information from being publicly disclosed to an entire community.

The Sun City Anthem Board of Directors, as well as, the association General Manager were well aware of the large number of volunteers seeking petition signatures to remove them...

...and they began to worry about the vast number of signatures being obtained to legally require an election that would be taking place, as well as, the contempt many had for the General Manager in 836 signed "no confidence" signers.

They knew they were possibly in trouble witnessing a community's loss of support for their governing decisions, and had to act!

And so they did....

It was literally a "preemptive strike" by the Treasurer and Board in order to avoid any formal rebuttal to association members, likely hatched by the new association attorney, at the beckoning of a highly paid General Manager, and allowed by a Board...

...that was OK'd by the Nevada Real Estate Division's Ombudsman's office.

Keep in mind, ALL the Recall advocates wanted  WAS TO TELL OUR SIDE OF THE STORY in order that THE PEOPLE COULD IMPARTIALLY JUDGE.

And then it became worse....

Those obtaining signatures were badgered constantly, being made to feel guilty for merely exercising the rights they had as an owner.

Once the required petitions were properly obtained and filed in accordance with Nevada law, one of those who was subject to the petition signings, Robert Burch, surprisingly escaped the removal election by only 2 votes.

Three individuals witnessed receiving copies of the actual petition signatures given them by Sun City Anthem Management, and upon examining what was given to them following an official Document Request,  and comparing them to WHAT WAS ORIGINALLY SUBMITTED, something was missing.....

...TWO PAGES OF SIGNATURES that would have placed Burch on the removal ballot...

...which were PROMPTLY PRESENTED to merely obtain a correct count.

Nothing was EVER ACKNOWLEDGED from Sun Anthem Management as a result.

Then...ANOTHER INCONSISTENCY....

This Document Request information provided to the three individuals  listed a large number of signed petitions which were invalidated.....

...which in certain cases were correct (examples included signatures of renters or double signing of spouses).

That was understandable...

But..after painstakingly going over Clark County records, it was PROVEN THAT 55 LEGITIMATE OWNERS WHO SIGNED THE BURCH REMOVAL PETITION...

..WERE NOT COUNTED.

That too, was brought to the attention of the General Manager...and IGNORED.

That PROVEN information that there were sufficient signatures to place Burch on the removal ballot was then the subject of another set of complaints to the Nevada Real Estate Commission's Ombudsman's office for review.

The General Manager and Board WOULD NOT review the DOCUMENTED evidence; and as such, once again, the only recourse available was GOVERNMENTAL assistance.

What other alternative was available ?

Again, at both time and personal expense, proper complaints were filed.

However...both of those complaints were, WITHOUT ANY EXPLANATION, denied by that organization, despite PROOF of the complaint.

Tomorrow in Part Three...we'll continue the next part of THE SCAM.

Apathy...and...Details of 2017 Removal Election Caused Loss of Confidence & Respect for Sun City Anthem ...Part One of Three

Why Removal Proponents Chose Not to Participate in The 2018 Sun City Anthem Board Elections
(Part One of Three)

Apparently those who support the incumbents are now trying "to sell them" by further criticizing those who supported the recall...

..this time criticizing them as to why no candidates came forward or were fully supported in the 2018 Sun City Anthem Board of Directors election...

...and even are going so far as ...

...criticizing and mocking them as a result.

What we are about to explain to you is a detailed summary as to WHAT TOOK PLACE during the Removal Election last fall...

...a well documented event by event documentary of what took place, who the players were, and the results.

It is so detailed, it takes THREE PARTS to tell it....

So...if you want it all, THIS IS MERELY PART ONE.

Image result for The Beginning

How sad it is when people are portrayed as villains who...

...saw corruption

...proved it existed

...brought out facts that were never disclosed elsewhere

...made a community aware of the many problems that exist...

...doing so at personal time and expense for one reason...

They loved their community.

While during all of it...

...were confronted with the most vile, insulting and unethical activity imaginable.

Those people saw something a "political machine" chose to withhold from those they pledged to represent...

...spending vast sums to maintain the control over a community, while using tactics that brought out what we believe were the worst in human behavior.

...doing anything and everything in their power to deny equal time to counter the many untruths that "machine" spewed.

While those who loved this community....

...yes, loved...

...believed that wrongs were committed by those we were supposed to trust...

...and...

...made every attempt to make a community aware of those problems...

...providing proof after hours of exhaustive investigation and a dedication to bringing honesty to a community that has been harmed again and again by secrecy, back door dealings, and financial waste.

Unless you lived in a cave and merely believed what another publication wrote....

...by an individual whose past was, and continues to be, so filled with DECEPTION, that at one point in his life, cost him the ability to practice law...

This is not who, but WHAT, the naive people of Sun City Anthem chose to believe during that time...

...ignoring COMMON SENSE all along the way.

...and was completely EMBRACED by each individual subjected to removal, as well as, the existing Board and General Manager of Sun City Anthem.

All of you were SCAMMED in what was the most contrived elective process in the history of Sun City Anthem.

... and now we'll tell you WHY.

Knowing that a removal petition was being circulated exposing them...

...and finding it shocking as to its success in obtaining the signatures in the short amount of time it did...

...the "machine" was now being confronted with an active attempt to expose and depose them...

And...they had to act !

An Association Treasurer would then "head them off at the pass" by writing and circulating a community sponsored formal eblast, as well as, post an article on an official community bulletin board, essentially condemning those who believed in the removal cause.

That in turn was circulated by a Sun City Anthem employee who in turn, sent that publication to Club members asking them to send it to their members...

...acts she would have no reason to do so...

...unless she was TOLD TO DO IT by an individual who had access to that particular Sun City Anthem email list, or by those who stood to be exposed....

...acts, that in the eyes of those who were obtaining the removal petition signatures, were thought to be both UNETHICAL as well as a violation of NRS regulations and Association CCRs involving unduly influencing owners.

When this appeared, formal attempts were made to rebut the Treasurer's publication to the Sun City Anthem General Manager in order to disclose to the entire community "the other side of the story"...

...something we believed to be a REASONABLE and FAIR request...

...however, the General Manager as per the instructions of the Board...

REFUSED that request.

We have in our possession that letter of refusal.

There was NO explanation as to the reason; it was FLATLY REFUSED without providing one.

Our question was then...

WHY, if they believed everything they were saying to a community was truthful, would they not allow others, to dispute what they were saying?

Was that not a reasonable request?

It would cost NOTHING, and the request merely asked if the same medium the Treasurer used, might be utilized in order to show impartiality.

After all, the word "transparency" had been a promise made by all who were elected, hadn't it ?

All that was desired was to tell the other side of the story in order that the people might have a better understanding as well as an alternative view on which to make an INTELLIGENT COMMON SENSE DECISION...

...but without any cooperation from the Board or General Manager, and a strong conviction that both sides should be heard...

...there was no other course of action available other then to seek GOVERNMENTAL assistance.

A complaint with the Nevada Real Estate Commission was then filed to obtain that fairness, and was DENIED.

Why was it denied?

Not that it wasn't a valid complaint, but instead...

Legal trickery...and tomorrow, in Part Two......

...we'll go into detail as to what it was !.

While Sun City Summerlin Opens Communiication....Sun CIty Anthem Threatens You With It

While Sun City Summerlin
 Welcomes Open Communication
 Sun City Anthem
Threatens You With It

As you have been made aware, Sun City Anthem Management in coordination with the Sun City Anthem Attorney, with acceptance by the Association Board of Directors, has now restructured a Document Request Form that, despite removing the necessity of signature, still contains numerous penalties toward those who would disclose any information to an outside party, subjecting that individual to:

Criminal Misdemeanor Charge
Fine
Civil Litigation

Is this "the norm" for Nevada Homeowner Associations, or is this an act designed to threaten and/or intimidate residents owners?

We did a bit of homework...

...comparing the restrictions placed on obtaining Sun City Anthem residents to those of our neighbor, the  Sun City Anthem Summerlin community, an HOA that has more homes and more amenities than Sun City Anthem...including three golf courses.

What is their position in obtaining community information?

  1. So the Sun City Anthem President is going to use an official community publication, The Spirit, to do what?

These are the words of a man who 1,282 unit owners believed was unfit to remain on the Sun City Anthem Board of Directors.

"These are my observations and may not represent that of the Board; however, I’m weary of any crackpot with a computer believing they have the power to bring a $10M organization to its knees by spreading maliciousness. I’ll have a more detailed look at that unfortunate aspect of the community in my May Spirit President’s article."

Well Mr. Weddle, since you feel it's your "DUTY" to likely write YOUR OPINION, on an OFFICIAL SUN CITY ANTHEM publication, why not give those who strongly disagree with YOU,  an opportunity to determine just who the real persons are whose actions have brought a $10 million organization to its knees...through deception?

Weddle, you wouldn't allow the Removal Proponents an opportunity to REBUT anything despite the official request to do so, using association funds on an attorney in the process, didn't you?

And to use a blog...one that is authored by an individual who lost his law license due to forgery, deception, and cheating a government agency as your only avenue to do so...

...when each and every independent blog in the Sun City Anthem community looks at him as a man whose life is dedicated to LIES, DECEPTION, and CHARACTER ASSASSINATION, sends this message to any INTELLIGENT individual:

YOU ARE WHO YOU ASSOCIATE WITH !

We know YOU NEED that "One trick Pony" to do you bidding, because without him, YOU and your bunch, would be history.

    So...

Are you going to give those who oppose your views an opportunity to REBUT your May report in the Spirit, or will you REFUSE THAT AS WELL?

We're calling your bluff, Mr. Weddle...to put up...or
    SHUT UP.

The only reason you would refuse is obvious...

WE'D EXPOSE AN ENTIRE COMMUNITY TO WHAT YOU AND YOUR BUNCH HAVE SPENT THOUSANDS ON AN ATTORNEY...

...the one who once worked for NANCY QUON, who committed suicide when she was exposed during the HOA scandal in 2009 through FBI investigations...

...to PROMOTE  STONEWALLING any opportunity to tell "the other side of the story".

Better yet, we'd love to put you on a lie detector.
    1. From Janet Cologna...to...Anthem Opinions

Am I correct.......If I request and obtain financial information and then tell my sister about it, I would / might be subject to Criminal Misdemeanor Charge, Fine, and / or Civil Litigation?
    2. Janet,

The "revised" Document Request form does not require a signature, but the numerous restrictions and penalties you mention are still a part of the form if you disclose anything you receive via that request, to a 3rd party.

We, in an Anthem Opinions article, asked if any Board member would state that any owner asking for information and providing it to a 3rd party, would subject them to these penalties?

What we got in response was SILENCE on this matter.

Instead, we got a response on the Berman blog from the Association President, that both ignored the request, and instead, got the above referenced quote about taking people to task.

This Board will act as judge and jury as to to whether anything you disseminate, violates their rules;  and yes, if you do, IN THEIR MINDS, does subject you to criminal misdemeanor charge, fine, and or civil litigation.

As our article points out, a comparison to Sun City Summerlin, that HOA offers this information TO ANYONE.  It's readily available on their website WITHOUT even USING A PASSWORD.

Still think my comparison between the Sun  City Anthem restrictions vs the openness displayed by Sun City Summerlin, isn't BIG BROTHER?
  1. From Royce Snyder...to...Anthem Opinions

I believe it has come time for the board, particularly the board members running for reelection, to demonstrate their worth by firing the costly and incompetent lawyer and reprehend the GM who seems to be tied to him.

Former Sun City Anthem & Foundation Assisting Seniors President Displays Board & General Manager's Treatment of Medical Equipment Provided Community for 16 Years

Former Sun City Anthem Board President

President of Foundation Assisting Seniors
Displays Sun City Anthem Treatment
of
Medical Equipment

Because of  the unprecedented salaries paid to the top 4...

...the fact that our accounting is handled off campus...

...our legal fees are so far out of budget, it is criminal...

This board is, apparently planning to subsidize a restaurant, and due to the cavalier way this group spends our money, I have decided to vote for only two of the candidates.

Namely Gary Lee and Clif Wigen.

They are the only two who are not in lock step with the rest.

This is what this Board and  Sun City Anthem General Manager, Sandy Seddon, did to the furniture and durable medical equipment owned by the Foundation..

A number of pieces were damaged so badly we had to discard them.

This displays a small amount that was returned to the Foundation, and how  badly damaged it was handled.

Pretty pathetic.

Anthem Opinions Comment:

The Foundation Assisting Seniors has served the Anthem communities for the past 16 years...and...continues to do so despite this ugly display of disrespectful treatment toward that organization.

While this travesty took place, the Sun City Anthem Board subsequently authorized and purchased $5,000 of medical equipment to serve the needs of Sun City Anthem.

A Waste of Association Funds

Who voted to remove the Foundation Assisting Seniors from Sun City Anthem and needlessly spent those funds?

These Incumbents running for reelection to the Sun City Anthem Board:

Aletta Waterhouse
Robert Burch
James Coleman

Do these individuals represent the "thanks" Sun City Anthem has owed this foundation for 16 years?

We believe none of them do, and should be sent packing as a result.

For those of you who need medical equipment, here is the current information of their new "home", conveniently located to continue the valued community service they have provided.

Why do I feel that the SCA residents are being treated just like the FAS equipment (dumped in a pile like trash)?
    1. From Barry Goldstein...to...Anthem Opinions

Just disgusting. Whoever did that has no class.
  1. From Favil West...to...Anthem Opinions

    The question is:

Did Sandy take a pay cut to come here as the board and David Berman tell us?

It appears that her 2015 salary, bonus etc. was about $215,000.

Did the board do a back ground check on Sandy.

Is she fit for the job?

So far from what I have experienced, have seen, and have heard excuses for, it appears that our board did not look into her background.

If a Senator, a Congressman, a judge, a City Manager,  a teacher, or an executive had inappropriate activities showing a lack of judgement would that person be found to be fit for the job? Would that person be able to keep the job?

Admittedly these questions are rhetorical----------------------or are they?

    1. From Linda Buckhardt...to...Anthem Opinions

I was at a City of Henderson meeting and I challenged City Atty. Josh Reid’s salary.

He said that his salary was $300,000.00, including benefits.

Now, don’t feel sorry for him, but Sandy is paid very well.
      1. Looks like the Sun City Anthem President, Rex Weddle, has confirmed that he is part of the Berman bull sheet.

We couldn't care less about a blogger who acts like a pig enjoying his daily mud bath; but as to Weddle, we have a few comments and questions for him regarding his latest insulting display of unprofessional behavior.

Did Weddle obtain a Document Request Form and what punishment will he face for disclosing information to a third party?

Did Weddle forget that HE LED THE PACK with having 1,283 residents consider him unfit for office a few months ago?

How pathetic is it that he needs a guy who lost a law license to defend him?

        What does that say ?

Weddle, how about we subject you to a lie detector test so we can ask REAL QUESTIONS and get REAL ANSWERS, rather than witness you dance around, saying NOTHING but MAKING SUBJECTIVE EXCUSES for what your're trying to peddle as the full truth?

And if you're going to open that little big mouth, STOP using an expensive association attorney to do it. All of us can't afford it much longer.

And, since you intend to use an official association publication, The Spirit, in May, to sound off, how about letting others REBUT what you write?

Better yet, how about letting Favil West do so?

        Are you scared?

We tried to get your bunch to allow a rebuttal to the biased report of the Treasurer during the removal election, but you shut that down, didn't you?

        Why?

Scared to let people know more than what you'd like them to know?

How much did the attorney charge the community  to stonewall that attempt?

This latest tirade of yours on DAB, just proved you're "in the pocket" of a man who will do anything to con a community...

...and in the minds of at least 1,283 owners, that put YOU in the same "con" category.

Let's see if the community believes YOU or Favil West, the guy who was a former Sun City Anthem Board President and President of the Foundation Assisting Seniors for years?

By the way, West never had people sign petitions to get rid of  him or just barely got elected to a Board, but you certainly did.
