OSCAR Letter: A Fraud Perpetrated on the Sun City Anthem Communty (Part Three of Four)

Referring back to Page 3 of the OSCAR letter, it further states:


“All meetings are announced to the community and include a published agenda.”

That is clearly misrepresenting the facts.

The letter and the Sun City Anthem Board are saying workshops are not meetings.

No matter what they have written, the board is holding secret meetings regardless of what you call them.

Again, why not the full truth?


On the last page of the letter, it states:

“The Foundation Assisting Seniors is not an official Association entity but has been occupying the Independence Center Annex.”

There is no such thing as the independence Annex.

In all fairness, I  believe it refers to the  Community Services Building which, according to Favil West, the man who negotiated this building for us, and current President of FAS, is now and always has been the Community Service Building.

Continuing, the letter then states: 

 “It is illegal to convey our unit owners common space in perpetuity to any organization (NRS 116.3112) and your board has taken action to correct this situation.”

After examining numerous documents, this building was negotiated, designed, built, and occupied by the Foundation. 

We could find no evidence that there was an intent to “convey” the property to the Foundation,  just as there was never an intent to use the words "in perpetuity" in the use of the facilities.

The actual words used by Del Webb/Pulte were:

that the Minuteman Foundation shall, as long as it continues to serve the needs of the residents of the community, continue to conduct the business of the foundation from that area known as The Minuteman Foundation Rooms consisting of a meeting area, small counseling office, larger inventory/counseling office; and THE MINUTEMAN FOUNDATION will store, distribute, maintain an inventory, and control all equipment in the storage area as long as they continue to serve the residents of the community; and THE MINUTEMAN FOUNDATION will have sole use of 2 parking spaces located immediately in front of the storage area for their van and truck as long as they continue to serve the community.” 

The declarant can do anything he wants during the period of declarant control.

The building was negotiated in 2002, approved in 2003 and delivered to the Foundation in mid-May 2005.

Sun City Anthem transitioned from Builder control to independence on May 31, 2005.

In speaking with Mr. West, he brought up this question:

"Is the Board also taking action to move the Neighborhood Watch out of the office they occupy, or the IT group out of the area they occupy, or the massage group out of the area they occupy?”

Good question !

These are outside organizations as well...and it would be interesting as to a full response.

The NRS is clear about equal treatment.


Sadly, there is a rumor about utilizing the space occupied by the Foundation Assisting Seniors.

General Manager Seddon, though unofficially wanting to convert the space for a dressing room and/ storage of props for Performing Arts and Spotlight Club entertainment venues, in reality may indeed want the Community Service Building for staff offices.

When we learned about these options, Mr. West also informed me that  97% of Foundation Assisting Seniors activity was conducted in Sun City Anthem.

So, just what are the priorities of Sun City Anthem as it continues to mature?

Should the Foundation Assisting Seniors offices be replaced with a dressing room or additional offices for Sun City Anthem employees?

    Are the ballots being sent out to each household and who is going to be counting the ballots?

    Apparently these four feel they are above the law.

    Is it possible they may be looking at jail time?

    Spending our money like drunken sailors.
  2. Robert, they are being sent by the CPA firm, and THEY are going to receive them. They will then apparently transport them to SCA for counting.

    You will shortly see some documentation regarding that procedure is a VIOLATION of Nevada Statutes.

    Stay tuned.

    For the way this bunch has "rigged" the mechanics of this election, they should be ashamed of themselves.

    I wish "jail time" was available, because what they are doing is unethical in the minds of ethical people.

    I have been reading much about recall of officers, but nothing about the status of petition regarding General Manager.

    What has been done regarding this petition?
  4. Norma, the 836 signed "No Confidence" petitions are nonbinding; however, you should be aware:

    a. The demand they be included in her employment file for consideration in future income and/or benefit increases.

    If the removal is successful...

    b. it is hoped their replacements will "read" the will of the people, and promptly REMOVE her and those she has conspired with to harm the Sun City Anthem community.

    Norma, what has taken place might be legal, and the efforts of those who oppose the removal constantly bark about not committed an illegal act.

    That has to be determined by the Nevada Real Estate Division by way of the numerous complaints that have been filed.

    Most advocates believe this recall is about ETHICS:

    ...treatment of residents with respect; open communication, wasteful spending of our assessments, secret meetings, and resuming an atmosphere of good feelings in a retirement community that all of us believed we entitled to when we all moved here from the various parts of the country and world.

    These people and their actions have robbed us of the wonderful aspects of life we believed we had, but over years have financially and emotionally, have sadly been allowed to erode to a point where so many people have finally stood up, signed petitions, and wanted their voices to be heard.

    ETHICS...that's what all us want...ETHICS.

    After reading Ron Johnson’s article this morning it has shown exactly what the situation is at SCA!

    Ron is a very bright and fair individual and has taken the time to dispel all the bs that we have had to cover up the lies we have been fed by Berman, the Board and the General Manager.

    Maybe the truth will finally set us free and we can become a community we are happy and proud to live in!

    No sir, we are all home owners. This was sent to me:

    “The particular carrier route that includes us has 395 homes, with our 145 in SCA and the others not. When this split route was mapped out for the OSCAR mailing, Highlands was overlooked."

    The election date was moved back to 10/9 so the letters mailed today should get to Highlands homes before the ballots.

    Our Director of Neighborhood watch received this information mentioned above.

    I am sorry this is just an excuse from whomever is doing the mailing.

    My friends on Logansport do not fall under this excuse.

    And yes they own their own homes, too.

    I will let you know if I receive the information in the mail.

    I am not holding my breath.

    The following letter is to be sent to everyone.

    I am sorry I do not get all of this.

    It all seems a run around. We definitely need to get these people OUT.

    I may have moved from SCA, but I still continue to love what I felt I had to leave.

    Many residents do NOT know all of the types of equipment the foundation provides when residents are In Need and they rush to the nearest medical supply store and rent hospital beds, walkers, wheelchairs, etc. the Service the Foundation provides is INVALUABLE to SCA residents.

    IF, as agreed, I had not deleted my personal SCA data base, I would forward the information and comment.

    To even consider using the space for Props or additional staff rather than storing medical equipment and a place for volunteers that deliver this equipment to homes and set it up for them, is alarming.

    This service is NEEDED in the SCA Active Adult Community.

    What ignorant thing will be done next without any thought to Residents and their needs???

    Another informative editorial.

    What a shame the Official site doesn’t have a space where info as important as this can be shared, giving residents a chance to comment.

    Sadly the community appears to remain pretty apathetic, and when it hits their pocket book its too late!

    I really do not know what it will take to get more residents involved or when they will stop believing the BS Berman and the Board puts out!

    Friends and Neighbors:

    In the 15 years the Foundation Assisting Seniors has been serving Sun City Anthem, its participation in local events has never been refused. 

    With the advent of Sandy Seddon and this SCA board of Directors the Foundation has been attacked and put under severe strain. 

    The board has made statements and claims in public meetings that are far-fetched, erroneous or at best grossly misleading. Unfortunately, some believe them, severely damaging FAS’ reputation and interfering with our ability to provide services, at no cost, to our senior clients. 

    Since SCA terminated the FAS affiliation agreement, we have seen the demand for service from SCA residents rise by more than 50%. 

    FAS is meeting the demand. 

    FAS is now providing its services directly to SCA residents; including transportation, maintenance, durable medical equipment, counseling, etc. 

    The Foundation van is out up to 6 days per week servicing every SCA request.

    In a letter received October 3, from Sandy Seddon, (attached) she denied the Foundation’s right to participate in the Craft Fair returning its check. 

    Resident Carol Chapman paid for the table for the upcoming Craft Fair to sell tickets for the October 29th FAS Basket Raffle to be held at Green Valley Resort. There are no rules or regulations that prevent outside groups from participating in the Craft Fair. This continuing attack on FAS is unprecedented. SCA allows others like Neighborhood Watch (an HPD program) which is similarly situated to participate.

    Basket Raffle tickets are available from the FAS office located in the Community Service Building, next to SCA TV.

    The Foundation Assisting Seniors began its life right here in Sun City Anthem in 2002. It was founded by Sun City Anthem residents. It has made over 100,000 assists just to SCA residents over the 15 years it has been active. It has never participated in nor taken an active part in any SCA politics and has never supported one candidate or issue over another. To date, it has not participated in the removal election. Perhaps that should change considering that the Foundation is being singled out by Ms. Seddon and the SCA Board while other outside entities are allowed to participate. This is, in our judgement, prejudicial and vengeful and will result in nothing less than harming our SCA seniors. This is an example of corporate bullying at its worst. Keep in mind, 97% of the assists made by the Foundation are made right here in Sun City Anthem and, 15 of its 20 trustees are Sun City Anthem Residents.

    Yesterday, as is the tradition of service by the Foundation, FAS donated 100 pieces of Durable Medical Equipment to senior victims of the recent hurricane in Houston. 

    The Durable Medical Equipment donated by the Foundation to the seniors of Houston is being packed by the McGoverns at the UPS Store in the Smith Center and shipped, at no charge, to Houston as part of a Las Vegas humanitarian effort.

    In 2003 the Foundation submitted a grant proposal to Pulte for a community service building. 

    Pulte accepted the proposal. 

    The Foundation President negotiated the design of the building, a building worth more than $550,000, to house the Foundation and services it started; SCA TV, Community Service, and Emergency Preparedness (all originally part of the Foundations Community Service Building). The result was that the building would be provided to the Foundation, with Pulte’s condition that the space would be dedicated to FAS so long as it serves SCA seniors. 

    This was evidenced by the original plans showing and referencing the Foundation space allocation. 

    This term was accepted by SCA and was documented by a board resolution at the SCA Board meeting in April 2007. 

    The Foundation Assisting Seniors has served and will continue to serve the SCA community as long as it is able..

    Now ask yourself this question, what has Ms. Seddon and/or this SCA board done to help anybody here at Sun City? except themselves ? 

    The Foundation is being harassed, lied to, misrepresented, bullied, and sued by this board, without the required member approval 

    For what? 

    We believe it is because Ms. Seddon and this SCA board want additional space for staff, or because they think they have the power and are out to harm the Foundation. 

    Is this how SCA should be managed?

    The Foundation Assisting Seniors continues to do the job that it set out to do 15 years ago and with your help we will continue to do so.

One director (Robert Burch) "supposedly" escaped the removal election by 2 votes; however, an official request was made to the Community Association Manager and General Manager to view WHICH were denied and THE REASONS as to why they were, a right guaranteed by Nevada law, that has yet to be acknowledged by either the Community General Manager and the Association Manager.

In the case of Burch, approximately 110 petition signatures were considered invalid by the CPA firm.

The matter has been discussed with Ombudsman Foger and he has informed the proponents that any activity to stifle such a request should  immediately be brought to his personal attention for assistance.

The OSCAR letter further asserts that:


“We have become an enviable success story.”

Really?  The people I have talked to, including the Ombudsman, seem to think our association has some severe problems. At least one family is selling their home and leaving because of the turmoil.

In addition the publication that listed Sun City Anthem a few years ago as the top retirement community in the United States, now has excluded it from the Top 50.

And again, I ask myself, why not tell the truth?

On page 2 of the OSCAR letter, it states:


“We no longer have to pay $36,000 per month to a management company.”

Again, that is "politically" correct; however, we do pay 5 employees a total of approximately $80,000 per month including benefits.

 And then, we pay the rest of the expenses.

Self management is not a part of the removal election, but, since it has been brought up by the opponents, we do know that the cost  has exceeded what we were told it would be.

So again, why not the full truth?

On page 3 OSCAR represents that:


 “There is no malfeasance by these 4 members of the board.”

Perhaps they should examine the definition of the word malfeasance.

It presents 4 bullet points which in and of themselves, do not make sense.

First:


 “The same small number of residents file most of the complaints.”

That is completely untrue in the case of this removal. 

Had that been true, the Ombudsman would not have taken measures as quickly as he did to formally investigate the multiple complaints made by multiple individuals. 

It then goes on to state:


The Ombudsman and the Nevada Real Estate Division have agreed that our Board has handled each situation correctly in all cases as long as these directors have been on the Board.”

No such agreement exists.

In fact, the Ombudsman is concerned about the operation of this Board as evidenced by previously referenced documentation. 

OSCAR bullet point 3 states unequivocally that:


There are ZERO open complaints in the Ombudsman’s office.”
That is false.

According to conversations with Ombudsman Foger, there are currently between 10-15 complaints from SCA residents in the Ombudsman's office now, many filed within the past 30 days. 

Now let me ask you, the reader, this question:

Do these 4 points make sense?

First, the letter stated a small number of residents file the most complaints.

Then it goes on to say that the Ombudsman and NRED have handled these issues correctly.

Then comes the statement that there are ZERO open complaints.

Finally the OSCAR letter states "the high volume of complaints" from a small number of people.

I ask you again, does this make sense to you?

If as stated, there are a small number of people filing complaints...

...but the authorities agree that this board has handled the issues correctly..

... but there are ZERO open complaints... 

...and finally tops it off by stating, the high volume of complaints... causes an increase in legal costs which you must pay for...

...Is that nothing more than a mere series of contradictions?

Is that treating residents like dummies?

Again, why is it so difficult to write the full truth?

    Just to let you know that many of us here in Highlands Village and other places have not received our ballots.

    I understand that the mailer should have been received last Friday or Saturday and so far it has not been received on Evening Sky, Thoreau, Thatcher, Fieldbrook or Danbury Crossing. Plus friends on Logansport.

    Something is very fishy.
  2. We have learned that the letters were not sent to those who rent homes. Could that possibly be the case with some of your friends?

    How the senders were able to differentiate which homes would and would not receive the letters,, is indeed VERY FISHY.  Someone provided the list to the OSCAR people.

    In addition, we were informed that an email was sent to Sandy Seddon from a resident asking about ballots being forwarded.

    "Coincidentally", the matter was shortly the subject of an article on the Berman blog...

    ...using almost THE EXACT VERBIAGE.

    That pretty much confirms our suspicions that SEDDON IS BERMAN'S MOLE and provides him information not provided to other publications.

    Just another example of the CORRUPTION that exists and MUST BE REMOVED.

OSCAR Letter...A Fraud Perpetrated on the Sun City Anthem Community (Part One of Four)

We fully support the Removal election.

Despite our dedicated volunteers being subjected to verbal abuse and derogatory commentary from a number of individuals opposing the removal...

...their belief in "bettering the system" drove them to collect the many petition signatures needed for the removal election to proceed.

They, unlike the opponents who collected large sums to send a letter to each Sun City Anthem home, believed in a cause...

...literally "walked" the "walk" while opponents arguments were centered on a blogger, his derogatory comments toward any who are in favor of the removal, and money !

Our volunteers do not, and  will not "buy" the conscience of a community through the collection of funds in order to mail each resident a letter, distorting so many facts in the process. 

If this is the manner in which the opponents choose to prevail, so be it.  

We will not join them in such activity.

Instead, we asking you to examine this series of four articles with an open mind to common sense.

Keep in mind, we have NO DESIRE of obtaining any power.  They do.

We have one objective; a harmonious community where "the golden rule" is the unofficial "law of the land".

Because we will not solicit funds, we are asking you to forward these articles to your neighbors and friends for examination, urging them to contact Anthem Opinions for any questions they might have.

Accordingly we will look closely at the letter sent from an organization named "OSCAR",championed by blogger, David Berman, and discuss the many untruths included in that correspondence.

Recently you received a four-page mailing telling you to vote "no" on the removal of Rex Weddle, Robert Burch, Aletta Waterhouse, and Thomas Nissen from some fictional organization called OSCAR which has been spearheaded by blogger, David Berman.

This letter is so full of misleading and false statements, it's difficult to believe that any thinking person, including the named former board members, would even allow their names to be associated with it.

 But...

...as our original article brought out the facts about the actions of many of those former members of the Sun City Anthem Board...NONE OF WHICH CAN BE DISPUTED, and I might add, ARE NEVER PUBLISHED BY DAVID BERMAN,  the propaganda goes on to maintain a system in which all of them were an active part.

Let's look closely at the OSCAR letter and literally "take it apart."

This is the first of a four part series of articles that address the FRAUD being perpetrated by the parties who oppose the Removal of the above named members of the Sun City Anthem Board.

On the first page of the “OSCAR” letter, the letter states:


The Directors have not been accused of any crimes or malfeasance.”

The truth is that there are currently more than 10 intervention affidavits in the Ombudsman’s office.

 A number have already been assigned Nevada Real Estate Division investigators by the Ombudsman, a man named Charvez Foger.

The charges against these directors range from Illegal termination, holding secret meetings, and failure to comply with equal time provisions of the law.

The letter goes on to say:


“Removal proponents are putting our wonderful community through an expensive, divisive and unnecessary election.”

This is partially correct.

We do live in a wonderful community and those who vote for the removal of these 4 board members want to keep it that way.

As far as divisive goes, Sandy Seddon, the Sun City Anthem General Manager, and the 4 board members to be recalled, have done more to divide this community than anyone can imagine.

The removal petitions and "no confidence" petitions against them were substantial, no matter how trivialized opponents have made them appear.

One cannot deny that they were completed despite the following actions, some of which have been the subject of FORMAL COMPLAINTS that the OSCAR letter has denied AND ARE PART OF AN ACTIVE INVESTIGATION by the Nevada Real Estate Division.

a. An eblast on Sun City Anthem letterhead by an officer of the Sun City Anthem Board of Directors, intended to interfere with those attempting to obtain signed removal petitions.

b. At the sanctioning of the Community Association Manager and General Manager, an email was sent by the Association Activities Director during normal business hours to the Presidents of all  Sun City Anthem Clubs, urging them to contact their members to oppose the removal, a violation of Sun City Anthem CCRs and Nevada law  in an attempt to influence the removal election.

c. Twice being denied equal time by the Sun City Anthem Board and General Manager to refute the above information provided in that eblast, a violation of Nevada law, and also the subject of multiple formal complaints against the Board, General Manager, and Community Association Manager.

d. A publicly posted document on an official Sun City Anthem Bulletin Board by a Sun City Anthem Board member which clearly expressed opposition to the petition gathering, another violation of Nevada law, and also the subject of multiple formal complaints.

e. The illegal removal of Director, Nona Tobin, violating her rights to a hearing by the Nevada Real Estate Division, to which a special investigator has also been assigned.

Keep in mind that despite the above activity intended to harm those who were seeking petitions, the necessary number were obtained to go forth with official removal of three of the directors, with the fourth under review by the Ombudsman.

    Thinking its a big mistake to not get a Vote Yes letter out to the community.

    We, like probably most people, have been forwarding your blog to friends regularly, but in speaking to people. In various clubs have found many who have never heard of your blog or have any idea what the recall is about.

    Thinking that number could be hundreds or thousands if you consider how many residents never use the facilities or interact with those of us that do.

    And if all they ever see is a Vote No letter and then a ballot comes in the mail, guessing there is a good chance that if they vote, it will be a no.

    Assuming you have no mass email access like when they do the e-blasts?

    Sure hoping we win, but feeling nervous about it.
  2. Robin, believe me, it probably would have helped considerably had we had a mailing, but the cost would probably be $3,000 to $5,000 to do so.

    Should we, the ones who try so hard for honesty, be forced to "compete" financially in order to have an honest system of governance? 

    Asking people for money is abhorrent in a community homeowners association. 

    We are supposed to be neighbors and have a "one for all and all for one" attitude, not BUY influence.

    This entire election process is lopsided and unfair.

    Want to review the Burch ballots that allowed him to fall within 2 votes of elective removal..you know, the announcement that was made a couple of days ago?

    No problem, use a Document Request Form and wait 21 days to get a response.

    Oh gee, that 21 days would take it past the deadline for the election wouldn't it?

    Think that wasn't intentional on the part of THE CORRUPT BUNCH?

    Even the ballots being sent the way they are, is a joke. 

    Sending them to a high priced outside CPA, and "hoping" they will count. 

    There is no checks and balance system in place.

    According to the "stacked deck", the ballots will have to have been received by the CPA firm by 5:00pm on Thursday, October 26th. 

    They will not even be counted unless they have a minimum of 2,501 received.

    So, what's to say that a number of them might "accidentally" fall in a garbage can if the number is close to the 2,501 ?

    Nothing...no fail safe security, and all up to THEM, a firm hired by THOSE WHO WANT THE REMOVAL TO FAIL.

    They could have done it in a manner that would have been fair to all sides, but doing it the way they are, more than proves how corrupt these individuals are to create a "stacked" election process.

    And the removal opponents blame us for the high cost...

    ...the high cost they spent to make sure they "would play with a deck of 51 cards".

    Anyone still believe this "system" is on the up and up?

Blogger Offers to Provide Postage for All Who Vote in Removal Election...Says He'll Pay No Matter How You Vote !

Every once in a while there are moments that must be taken advantage of when someone says "I'll pay for it".

...and when it comes to the Sun City Anthem frivolous spending record of  David Berman's candidates whom he endorses year after year, there's no one better than him when it comes to spending other's money.

But...

He's made an offer that I believe all 7,144 homes in Sun City Anthem should take advantage of, and Anthem Opinions fully endorses his pledge.

He made the following comment on his blog:

    Now he wants you to meet him personally in a prearranged appointment on his terms.

    Of course he never mentioned that part in his original offer.

    Always "read between the lines" when it comes to this guy because, like his articles, there's always "more to the story", isn't there?

    It's like the commercials that you see on TV where you buy one, but they give you something else free; however, at the same time, the "shipping and handling" charges are more the original purchase.
